Davis Graham & Stubbs LLP regularly advises clients on federal historic preservation and cultural resources laws, including the National Historic Preservation Act (NHPA) and Native American Graves Protection and Repatriation Act (NAGPRA), for issues arising on federal, Tribal, and nonfederal lands. We advise project proponents on the NHPA section 106 consultation process and negotiate programmatic agreements with federal agencies to address potential impacts from projects on historic properties, including Tribal sacred sites. We also advise on and engage in discussions with Tribes regarding projects and their impacts both on and off Tribal lands. This support includes developing early-stage engagement strategies, advising on the NHPA section 106 consultation process, providing cultural awareness and communication support, and facilitating the negotiation and drafting of various agreements with Tribes, including those related to exploration access, cultural resource mitigation, and cooperative development.   

Davis Graham also advises both property owners and historic preservation organizations on historic designation, historic preservation, and adaptive reuse projects. We have significant experience in the preparation, negotiation, and implementation of historic preservation tools, including historic preservation easements, restrictive use covenants, historic tax credits, and financing for the acquisition, rehabilitation, or adaptive reuse of historic structures.
