Amidst its many challenges and priorities, the new Administration has already initiated major changes to public lands and environmental policies, with more change to come. During his campaign, President Biden pushed back on charges that he would ban hydraulic fracturing, but also committed to halt oil and gas development on federal lands to instead promote wind and solar energy. Energy development on public lands, however, constitutes just one pivot in a suite of anticipated pivots in federal policy affecting energy development. For example, the Biden-led EPA has resumed the Obama-era federal enforcement and regulatory programs designed to significantly cut methane emissions from the oil and gas sector. Significant changes with impacts across industry sectors are also already in progress or anticipated relative to 404 permitting, the Superfund program, emerging contaminants, and other major initiatives. This discussion will highlight the tools the Administration is using to jumpstart its agenda, including Executive Orders, guidance, and enforcement to effectuate these changes.
