Shane Niebergall is a partner in the Intellectual Property & Transactions Group at Davis Graham & Stubbs LLP. Shane has over 25 years of experience in intellectual property law, emphasizing U.S.-based and international property counseling, litigation, and patent prosecution. He delivers highly customized client service by developing patent portfolios that act as competitive barriers and new revenue generators.
Shane extensive knowledge of technology enables him to collaborate closely with clients and gain a thorough understanding of their unique needs and business objectives to craft comprehensive patent strategies tailored to each client’s specific industry. By aligning his approach with his client’s goals, he helps them develop effective corporate policies for identifying, evaluating, and monetizing their patentable technologies. Shane impressive record of preparing and prosecuting numerous patent applications spans diverse technologies, including medical devices, robotics, telecommunications applications, software/business methods, wastewater treatment facilities, irrigation systems, and mechanical and electrical components. In addition, he has prepared non-infringement, validity, and patentability opinions by analyzing his clients’ and competitors’ technologies in these fields.
Shane has also litigated plaintiff and defendant positions in patent infringement actions and argued before the Court of Appeals for the Federal Circuit. This litigation expertise provides him with valuable insights that benefit his patent practice. With a dedication to securing market dominance and protecting his clients’ technologies, Shane is committed to delivering results and helping his clients achieve their objectives.
Prior to joining Davis Graham, Shane was a Shareholder in the Denver office of an international law firm, where he specialized in patent prosecution. Earlier in his career, he worked as a partner at another international law firm and served as of counsel at a national law firm. In these roles, he was responsible for managing the patent portfolios for a broad range of publicly traded companies.
Shane received his J.D. from Creighton University School of Law. While in law school, he served as the associate editor for the Creighton Law Review. He earned his B.A. from the University of Colorado Boulder.
In addition to Colorado, Shane is currently admitted to practice before the U.S. Patent and Trademark Office, U.S. Court of Appeals for the Federal Circuit, U.S. Court of Appeals for the Eighth Circuit, and U.S. Supreme Court.
