Cultural Resources

Davis Graham & Stubbs LLP regularly counsels clients on issues associated with historic preservation and cultural resources. We advise project proponents with issues arising under the National Historic Preservation Act (NHPA), including the section 106 consultation process. We have substantial experience with cultural resources located on federal public lands managed by the Bureau of Land Management or U.S. Forest Service, including the sensitive issue of Tribal sacred sites. We have negotiated multiple programmatic agreements with federal agencies to address potential impacts from projects on historic properties and Tribal sacred sites.

We also advise both property owners and historic preservation organizations on historic designation, historic preservation, and adaptive reuse projects. We have significant experience in the preparation, negotiation, and implementation of historic preservation tools, including historic preservation easements, restrictive use covenants, historic tax credits, and financing for the acquisition, rehabilitation, or adaptive reuse of historic structures.
