Lindsay Dofelmier is counsel in the Energy & Mining Group of Davis Graham & Stubbs LLP. Operating at the leading edge of the energy transition, Lindsay leverages a deep understanding of regulatory and transactional landscapes to meet her client’s strategic business needs. With experience in the private, government, and non-profit sectors, when dealing with corporate transactions, compliance, and commercial litigation, she brings valuable insight to a range of natural resources, environmental, and energy issues ranging from critical minerals/rare earths, mining, renewables, endangered species, water law, public lands, and Tribal consultation.
Lindsay’s practice is global and spans all facets of natural resources law and all stages of project development. She advises clients on resource development on public, private and Indian lands, complex commercial transactions, permitting, compliance, disputes, and issues arising under federal and state statutes related to energy, the environment, and natural resources. Lindsay provides full-service support for her clients in complex extractive and energy industry transactions and disputes – from conducting front-end due diligence and ESG consulting to drafting and negotiating merger agreements and related financing and investment instruments, providing daily operational support for projects, and representing clients in state and federal courts.
Prior to joining Davis Graham, Lindsay was an associate in the Houston and Denver offices of two major international law firms, where her practice focused on all facets of natural resources law, and a legal fellow in Defenders of Wildlife’s Denver office, where she worked on a variety of legal matters related to conservation and special status species. Lindsay also clerked for the Honorable Melinda Harmon of the Southern District of Texas and is admitted to practice before the Tenth Circuit Court of Appeals and the U.S. District Court for the District of Colorado.
Lindsay is a member of the Turtle Clan of the Onondaga Clear Sky First Nation of the Haudenosaunee (Iroquois) Confederacy.
Representative Experience
- Advising nickel producer on federal regulatory (e.g., NEPA) and Tribal engagement issues related to proposed mining projects in the Great Lakes region
- Assisting lithium producer with Tribal engagement matters and drafting various cooperation agreements with relevant Tribes
- Advising infrastructure investment firm on its investment to expand a major federally recognized Tribe’s farming operations through a joint venture between the parties
- Advising major automotive manufacturer on international and domestic transactions relating to the acquisition of lithium and other battery metals
- Advising various mining companies on the acquisition of land and mining claims and federal and state permitting process for uranium, trona, gold, silver, and rare earths projects
- Advising clients on the strength of various arguments under the 1872 Mining Law in mineral disputes
- Advising clients on the regulatory requirements and challenges to infrastructure and energy projects in connection with various federal environmental laws and their state analogues, including the Resource Conservation Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the National Environmental Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA), the Endangered Species Act (ESA), the National Historic Preservation Act (NHPA), and the Clean Water Act (CWA)
